This End User Agreement ("Agreement") is a legal agreement between you ("User") and Incredible Dinosaur ("Company") regarding the use of the Yalt and Yalt Business mobile applications ("App").

By using the App, you agree to be bound by the terms of this Agreement.

Collection of Consumption Behavior Data

The App is designed to collect data on User's consumption behavior through the use of loyalty cards. This data includes, but is not limited to, purchase history, spending habits, and frequency of store visits. The Company will use this data to improve its products and services, and may share the data with third parties for the same purpose.

The Company may share User's consumption behavior data with third parties, such as advertisers and market researchers, for the purpose of improving their products and services. User's personal information, such as name and contact information, will not be shared. The Company will take measures to ensure that any third party with whom it shares data is subject to strict confidentiality and security obligations.

Price change and limitation of functionnalities

The Company may at any point decide to introduce paid plans and or restricts some functionalities if needed. In case of such event, the company will inform the users with at least a month of notice.

Opt-Out

If User does not wish to have their consumption behavior data shared with third parties, they may opt-out by emailing hello[@]yummypass.co with their request. In the event that User opts-out, their data will not be shared with any third party, and will only be used by the Company to improve its products and services.

Disclaimer of Warranty

The App is provided "as is" and without warranty of any kind. The Company makes no warranties, express or implied, regarding the App, including, but not limited to, warranties of merchantability or fitness for a particular purpose. The Company does not warrant that the App will be error-free or that it will meet User's requirements.

Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the App, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if the Company has been advised of the possibility of such damages.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Lisbon / Portugal, without giving effect to its conflict of laws provisions. Any dispute arising out of or in connection with this Agreement shall be resolved in the courts of the [State/Province].

Entire Agreement

This Agreement constitutes the entire agreement between User and Company and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to the subject matter of this Agreement.

By using the App, User agrees to be bound by the terms of this Agreement. If User does not agree to the terms of this Agreement, they must immediately discontinue the use of the App.
